This Public Offer for charitable donations (hereinafter – the Offer) is aimed at an undefined number of individuals (hereinafter – the “Donor”) who are visitors to the official website of the Religious Department of The Salvation Army in Ukraine (hereinafter – “The Salvation Army in Ukraine”), official website is www.salvationarmy.org.ua (hereinafter referred to as the “Site”) and wish to make a charitable donation within the meaning of this public offer (hereinafter referred to as the Charitable Donation Agreement), collectively referred to in the text of the Offer as the “Parties”, and each individually as “ Side”.

The text of the Offer is an official proposal of the Religious Department of The Salvation Army in Ukraine, represented by Kostyantyn Mykolayovych Shvab, acting on the basis of the Statute, to enter into a Charitable Donation Agreement (hereinafter referred to as the “Agreement”), the essence of which is set forth below.

Terms and definitions:

Acceptance – full and unconditional acceptance of the Public Offer by taking actions to make a money transfer using the payment forms and means posted on the “Site”, as well as by transferring funds to the current account of The Salvation Army in Ukraine through bank institutions. The moment of Acceptance is the date of transfer of funds to the current account of The Salvation Army in Ukraine. Payment is a voluntary charitable donation. Voluntary charitable donation – a monetary transfer made by the “Benefactor” to achieve the goals of the Social Programs for the population of Ukraine in accordance with the Treaty and the Law of Ukraine “On Freedom of Conscience and Religious Organizations”.

Subject of the contract:

The subject of this Agreement is the free transfer by the “Benefactor” to The Salvation Army in Ukraine of funds to achieve the goals of the Social Programs for the population of Ukraine. Acceptance of the Agreement means that the “Donor” agrees with all its Provisions, he is fully aware of the subject of the Agreement and the purpose of collecting donations. The Agreement is concluded by unconditional and full accession of the “Benefactor” to this Agreement and acceptance of all essential terms of the Agreement. “Benefactor” and “Salvation Army” in Ukraine, guided by Art. 207, Part 2 of Art. 639, art. 641, 642 of the Civil Code of Ukraine, art. 18 of the Law of Ukraine “On Freedom of Conscience and Religious Organizations”, agree that the Agreement is considered concluded in writing without the signing of a written copy by the “Parties” from the moment the “Benefactor” takes the actions provided for in the Agreement, which indicate the agreement to comply with the terms of the Agreement. The Agreement is posted on the website www.salvationarmy.org.ua in a freely accessible manner and in a way that ensures familiarization with the content of this Agreement for every person who applies to The Salvation Army in Ukraine. The benefactor cannot offer his terms of the Agreement.

Rights and obligations of the Parties:

The Salvation Army in Ukraine has the right to:

  1. To receive voluntary charitable donations and use them to achieve the goals of Social Programs for the population of Ukraine in accordance with the Treaty and the Law of Ukraine “On Freedom of Conscience and Religious Organizations”.
  2. At the request of the “Benefactor”, provide a report on the voluntary charitable donation received and its use.

The “philanthropist” has the right:

  1. Transfer a voluntary charitable donation to the account of The Salvation Army in Ukraine in the manner specified in the Agreement;
  2. Request a report on the use of a voluntary charitable donation.

Place of fundraising:

Voluntary charitable donations are collected on the territory of any country in the world.

Deadline for fundraising:

The collection of voluntary charitable donations continues indefinitely, unless another term is determined by The Salvation Army in Ukraine.

The procedure for general access to the reports of The Salvation Army in Ukraine.

Access to the reports of The Salvation Army in Ukraine is carried out by contacting the leadership of The Salvation Army in Ukraine at the address indicated on the website www.salvationarmy.org.ua. Other information can be provided by The Salvation Army in Ukraine  in the manner and within the time limits provided by the legislation of Ukraine.

Other conditions

The “Benefactor” bears all expenses for the payment of sums related to the transfer of the donation. The “philanthropist” independently determines the size of the voluntary charitable donation. Donation is voluntary and non-refundable. The “benefactor” is responsible for the accuracy of the information provided when transferring the donation. In order to comply with the Law of Ukraine “On the Protection of Personal Data” and to properly fulfill the terms of the Agreement, the Benefactor consents to the processing of personal data. The provisions of the Ukrainian Legislation apply to the relationship between the “Benefactor” and The Salvation Army in Ukraine.
